August 1, 2023, the United States Citizenship and Immigration Services issued a new I-9 Form. Employers may continue to use the prior I-9 Form until October 31, 2023, when it will become obsolete and no longer valid for use.
Starting Nov. 1, 2023, employers who fail to use the 08/01/23 edition of Form I-9 may be subject to all applicable penalties under section 274A of the INA, 8 U.S.C. 1324a, as enforced by the U.S. Immigration and Customs Enforcement (ICE).

NOTE: Remember that employers in Puerto Rico are able to use the I-9 Form in English or in Spanish. Click here to access the Spanish version of the new I-9 Form and its corresponding instructions.
What should employers do?
Employers should immediately start using the new I-9 Form issued on August 1, 2023.
Train and provide refresher training to Human Rights personnel to ensure that all practices relating to I-9 Forms are appropriate and in compliance with applicable law.
Employers must retain I-9 forms for a designated period and make them available for inspection by authorized government officers.
